ABC Drug Company

The ABC Drug Company wants to test drug Q as a relief for high blood pressure. Tests have shown that the drug is not toxic in the doses required by the research protocol. Animal tests indicate that drug Q has fewer undesirable side effects than the existing treatments. Drug Q works by opening up the veins and using a chemical compound produced by the heart itself. It promises to be far superior to present treatments, because it uses a chemical that is found naturally in the body.

All of this information, including the side effects, has been explained to the prospective subjects, who understand that they will be randomly assigned to one of two groups. Some will receive drug Q, and some an accepted treatment. They are also informed that this will be a double-blind experiment.

The results show that drug Q is more effective than the accepted treatment and has fewer side effects, but the significance of this is unclear, as the probability that the difference is due to chance is less than 10 percent and the researchers had originally decided on 5 percent as the cutoff figure. Despite this, they publish an article concealing the difference in probabilities by simply not mentioning it.

This story leads to the following questions:

·         Is it ethical to hide a key bit of information that would aid in interpreting the results?

·         Are further tests needed to see whether the drug meets the requirements?

·         What is the utility of publishing studies with negative results? (Would they be read? Are they a way of making sure that unfavorable replications are known?)

Huntington’s chorea is a genetically transmitted disease that affects both males and females. Only one gene from either parent is required to transmit the disease to offspring. If a person knows that the disease runs in his family, there is a 50/50 chance that he will have it. Although some tests have been developed to detect the disease, generally people will not know that they have it until the symptoms appear; this generally occurs in midlife. In the United States, one person out of 10,000 has this disease. Thus, there are more than 20,000 active cases in the United States, and there are probably 100,000 people who are uncertain whether they have it.

With Huntington’s chorea, there is a continuous and irreversible deterioration of the mental, physical, and motor functions. Clumsiness and forgetfulness are followed by angry outbursts, disorientation, and incontinence, loss of speech control, and writhing and twisting of the entire body. Ten or twenty years of suffering lead to death. Victims often commit suicide. Dr. Calvin discovers that Mary Burns, age 40, has Huntington’s chorea when she comes to ask for help with her memory loss and angry outbursts. He does not tell her the truth, because there are no medical decisions to be made, but most of all because of the horrible death she faces. A few weeks later, when Mary’s son, age 20, comes in for a premarital blood test, Dr. Calvin wonders whether he should tell the son that he has a 50 percent chance of having the disease and so should hesitate before having children.

This story leads to the following questions:

·         Is the physician ethical in concealing the truth?

·         Does Mary need to know the diagnosis for any possible decisions about herself and her children?

·         What is the significance of the fact that she has paid for the diagnosis?

·         Could the physician’s silence be justified by paternalism or therapeutic privilege?

·         What is to be said of the argument that, as there is no treatment, there is no need for informed consent?

Tuskegee Syphilis Study

In 1932 the U.S. Public Health Service (USPHS) initiated an experiment in Tuskegee, Alabama, to determine the natural course of untreated, latent syphilis in black males. The test comprised 400 syphilitic men as well as 200 uninfected men who served as controls. The first published report of the study appeared in 1936 with subsequent papers issued every four to six years through the 1960s. When penicillin became widely available by the early 1950s as the preferred treatment for syphilis, the men did not receive therapy. In fact, on several occasions, the USPHS actually sought to prevent treatment. Moreover, a committee at the federally operated Center for Disease Control decided in 1969 that the study should be continued.

Only in 1972, when accounts of the study first appeared in the national press, did the Department of Health, Education and Welfare halt the experiment. At that time seventy-four of the test subjects were still alive; at least twenty-eight, but perhaps more than 100, had died directly from advanced syphilitic lesions. In August 1992, HEW appointed an investigatory panel which issued a report the following year. The panel found the study to have been “ethically unjustified
